POTTSVILLE MAN FOUND NOT GUILTY OF FIRST-DEGREE MURDER IN ROAD RAGE TRIAL
HIGH PROFILE CASES
Mr. Nenner’s client faced first degree murder, third degree murder and various other charges. The Commonwealth alleged that Mr. Whitted stabbed and killed a driver after an incident at a red light in West Brunswick Township.
Throughout the trial, Mr. Nenner argued that the prosecution failed to prove first and third degree murder and also argued that the jury consider self-defense because his client was scared for his life after an aggressive road incident with the decedent. Mr. Whitted testified that prior to the stabbing, he encountered the decedent who was driving in an aggressive manner, cutting Mr. Whitted off and breaking hard in front of him, trying to make Mr. Whitted hit the back of the decedent’s vehicle. Mr. Whitted also testified that when the two drivers approached a stop light, the decedent exited his vehicle and approached Mr. Whitted in an aggressive manner.
The jury returned a NOT GUILTY verdict on the first degree murder charges and was unable to reach a verdict on the third degree murder charge.
